WMC Manager Accused of Murdering Parents

Prosecutors plan to appeal David Boysen dismissal

Twenty-five years ago, Southern California mortgage lending manager David Boysen said he was devastated by the murder of his parents.In May 2004, he was in disbelief when San Diego County prosecutors charged him with the crime.

But on May 25 of this year, Boysen, 48, was thankful for finally being released from jail after a judge dismissed the charges against him.

“I was falsely accused,” Boysen told MortgageDaily.com. “They had the wrong man. I’m happy to be vindicated and I looking forward to starting over.”

Prosecutors disagree they had the wrong man and plan to appeal the ruling by San Diego Superior Court Judge Joan Weber, who found that the case was so cold and so much time has passed that Boysen was denied his constitutional rights to a fair trial.

“We’re appealing because the evidence will show that we have the right man,” San Diego County Deputy District Attorney Jeff Dusek told MortgageDaily.com. “The judge dismissed the case for technical reasons. We want to go to trial.”

Dusek said it will likely be at least a year before a state appeals court hears the appeal.

Meanwhile, Boysen said he plans to return to his job at WMC Mortgage Corp., a Los Angeles-based subprime wholesaler where he worked for several years before his arrest last year.

“I want to get on with my life,” he said. “I want to get back to work. My employer has stood by me all along. They were always there, and I knew when I got this past me I could go back to work.”

Boysen would not discuss specifics of the case, but he did profess his innocence in the shooting and beating deaths of Robert and Elsie Boysen, whose bodies were discovered in their Oceanside, Calif., home on April 6, 1980.

Boysen’s defense lawyers argued in court filings that potential witnesses have died and there is a lack of evidence tying their client to the crime.

The judge concurred with some of defense’s points in her ruling, including the lack of witnesses; the fact that Boysen didn’t confess; and the absence of forensic evidence tying him to the killing.

There were no arrests at the time. The district attorney’s office has not said what specifically prompted them to reopen the case.

Boysen said he just wants to put the arrest behind him. He said it was difficult when his parents died, but to be arrested for the murder was devastating.

“Yeah, it was pretty tough,” he said. “The murders were an absolute horrible ordeal. To know your parents were murdered is difficult to deal with, very difficult.

“But it’s during times like this that you find out what is really important to you and who is there for you,” Boysen said. “If it wasn’t for my family, my faith, my friends and my employer I don’t know what I would have done. They got me through this.”
